Nearo Terms of Service

1. General provisions

These Terms of Service (hereinafter: “Terms”) govern the use of the Nearo mobile application (hereinafter: “App”) available on iOS and Android platforms, provided as an electronic service.

The App is provided by Piotr Lechnio, a sole proprietor based in Warsaw, Poland (hereinafter: “Provider”). Contact: contact@nearo.pl.

By using the App, you accept these Terms and the Privacy Policy.

2. Definitions

• App – the Nearo mobile application available on Apple App Store and Google Play.
• User – a natural person aged 18 or older who has created an account in the App.
• Account – a set of data assigned to the User upon registration.
• Settlement – a local community within the App, accessible after verification with a settlement code.
• Listing – content published by a User in the settlement feed.
• Chat – a private 1:1 conversation between two Users in the context of a Listing.

3. Service description

The App enables verified residents of a given Settlement to:

• Publish Listings in categories defined by the Provider (e.g., parking, neighborly favors, recommendations, questions, lost items).
• Conduct private 1:1 conversations (Chat) with other residents in the context of a published Listing.
• Report content or behavior violations by other Users.
• Contact Support via an in-app form.

4. Registration and verification

Registration requires providing a phone number in international format (E.164). The Provider sends a one-time OTP code via SMS to verify the number.

After phone verification, the User provides a display name, street, and building number, then enters the settlement code received from the building manager or a neighbor.

During registration, the App requests one-time access to the device’s GPS location to verify the User’s presence within the declared Settlement area.

Registration is free. Use of the App is free of charge.

5. User Account

Each User may have one active Account tied to one phone number.

The User is obligated to provide truthful data and must not share their Account with third parties.

The User may edit their notification settings at any time.

6. Listing publication rules

• A Listing must contain a title and a description.
• A photo may be attached to a Listing.
• A Listing is visible only to verified members of the Settlement to which the User belongs.
• A Listing is active for the period defined for its category (default up to 14 days), after which it is automatically closed.
• The User may end their Listing at any time.

7. Prohibited content

The User agrees not to publish content that:

• Violates Polish or EU law.
• Constitutes spam, fraud, or an attempt to solicit personal data.
• Contains offensive, hateful, discriminatory, sexually explicit, or violence-promoting content.
• Infringes the intellectual property rights of third parties.
• Relates to illegal activity or may endanger child safety.
• Impersonates another person or discloses third-party personal data without consent.

8. Chat

Chat conversations are private (1:1) and are initiated in the context of a specific Listing.

A User may block a conversation with another User. Blocking prevents further communication within that conversation.

9. Reporting violations

A User may report a Listing or Chat message that violates these Terms by selecting one of the following categories:

• Spam or scam
• Harassment
• Hate speech
• Sexual content
• Violence
• Illegal activity
• Child safety
• Impersonation
• Privacy violation
• Other

10. Moderation and sanctions

The Provider reserves the right to:

• Remove or hide content that violates these Terms.
• Temporarily or permanently block the Account of a User who violates these Terms or the law.
• Review reports to assess validity and take appropriate action.

11. Push notifications

The App may send push notifications regarding: new Chat messages, new Listings in selected categories, and system messages from the Provider.

The User may disable individual notification types in Settings or disable notifications entirely at the operating system level at any time.

12. Intellectual property

All elements of the App (source code, graphics, layout, logos) are the property of the Provider or are used under license.

The User retains rights to the content they publish, while granting the Provider a non-exclusive, royalty-free license to display such content within the App for the duration of publication.

13. Liability

The Provider is not responsible for content published by Users.

The Provider makes reasonable efforts to ensure the App functions correctly but does not guarantee uninterrupted and error-free availability of the service.

The Provider does not mediate transactions between Users and bears no responsibility for their outcome.

14. Account deletion

The User may delete their Account at any time via the option in their Profile (“Delete account”). The process is irreversible.

After deletion: (a) the Account status is changed to deleted; (b) the phone number is anonymized; (c) active push tokens are deactivated; (d) active Listings are closed; (e) the display name in Chat conversations is replaced with “Deleted user”.

The User may also request Account deletion by emailing contact@nearo.pl.

15. Technical requirements

• A mobile device running iOS 16+ or Android 10+.
• An active internet connection.
• Ability to receive SMS (for OTP verification).

16. Complaints

Complaints should be submitted by email to contact@nearo.pl.

The Provider will address complaints within 14 days of receipt.

17. Amendments

The Provider reserves the right to amend these Terms. Users will be notified of material changes via push notification or an in-app message at least 14 days in advance.

Continued use of the App after the changes take effect constitutes acceptance. If the User does not accept the changes, they should delete their Account.

18. Final provisions

These Terms take effect on the date of publication.

If any provision of these Terms is found invalid, the remaining provisions shall remain in force.
